Terms & Conditions
1a. Cavendish Flowers reserves the right to substitute contents or packaging of all products featured if unavailable. Products will be substituted with those of equal or greater value, and colours matched where possible, without notifying the customer. All products are subject to availability.
1b. Sometimes flowers will be delivered in bud to ensure longer life.
1c. Some products may be harmful if ingested and all products (excluding chocolates and fruit and veg) are for ornamental use only.
2.Prices
2a. A delivery charge of £4.99 will apply to all orders to be delivered on the same day and to one address.
2b. All prices are inclusive of VAT at 17.5%
3.Orders
3a. To ensure successful delivery all recipients details must be correct and include full name and full address including postcode. A contact telephone number where possible is very helpful. For international orders the recipient's telephone number must be provided in addition to the address details. Incorrect details may lead to a delayed delivery or non-delivery.
3b. Customers are required to provide us with daytime telephone number and e-mail address in case of query.
3c. Your order will be processed once payment has been received. We accept all major credit and debit cards including AMEX.
3d. An order confirmation e-mail will automatically be sent once we have received your order and will be sent to the e-mail address you have provided.
3e. You will be issued with an order number for each order placed which is to be used in any correspondence.
3f. By placing an order you confirm you are agreeing to Cavendish Flowers Terms and Conditions.
3g. No deliveries will be made on Sundays (with the exception of Mothers' Day at the discretion of Cavendish Flowers) or Bank holidays. Orders received for these days will be delivered on the next working day.
3h. Discount codes and gift vouchers. These must be entered at the point of order entry in the box provided on the check-out page. The discount applies to products only and not the delivery charge. Gift vouchers and codes cannot be exchanged for cash.
4. Delivery
4a. A delivery charge of £4.99 will be added to all orders.
4b. For orders outside of Mainland UK an additional charge of £5.00 will apply.
4c. Same day delivery to mainland UK is usually possible for orders placed by 12pm.
4d. Next day orders will be delivered Tuesday - Saturday and must be received by 12pm. An additional charge of £2 will apply for orders to be delivered on a Saturday (this is a Royal Mail charge)
4e. The majority of next day orders will be despatched from Cavendish Flowers and delivered using Royal Mail next day guaranteed delivery by 1pm. In some cases a third party florist will complete your order.
4f. Same day and Next day orders - some orders will be processed by selected third party florists.
4g. Delivery times. Funeral orders will be delivered to the requested address or funeral director at least 1-2 hours before the funeral. The customer is required to provide the funeral time. All other deliveries: an AM or PM preference can be requested but it is only a preference. Whilst we will try to meet your time requirements it is not always possible.
4h. Deliveries (with the exception of funeral orders) will be delivered between 8am and 8pm. Any requests and orders for businesses, schools etc will be taken into account. Next day orders delivered by post will be delivered by 1pm, a card will be left by the Post Office if there is no-one in. The recipient should collect these as soon as possible, flowers are packed in a 24 hour keep fresh bag.
4i. In exceptional circumstances we may not be able to meet your requested delivery day. The customer will be contacted to arrange a different date or a full refund will be given if the order is to be cancelled.
4j. For deliveries outside of mainland UK. It may not be possible to process same day orders or orders on international holidays. The customer will be contacted if we cannot meet your requested delivery date. The customer should order at least 48hours before the requested delivery date to assist Cavendish Flowers in meeting your requested date.
4k. If we have difficulty in delivering your order Cavendish Flowers or the third party florist may need to contact the recipient via the telephone number provided or by tracing the number to ensure the delivery is made.
5. Order Tracking
5a. The customer will not be automatically sent a delivery confirmation but this can be confirmed by telephone or e-mail if you request this. Your order reference number should be used when contacting Cavendish Flowers.
6.Cancellation
6a. All non-perishable items may be cancelled by 12pm the working day previous to delivery by telephone or e-mail.
6b. All perishable orders may be cancelled up to two working days before the order is to be delivered, by telephone or e-mail.
6c. Full refunds will be given within 7 working days to orders cancelled within the periods stated above.
6d. Late cancellations. The customer should contact Cavendish Flowers as soon as possible to cancel any orders. If it is after the periods stated in 6a and 6b, we will do our best to cancel the order and give you a full refund. In the event that the order cannot be cancelled the payment from the customer will be processed.
6e. To cancel or amend your order please contact Cavendish Flowers by e-mail or telephone quoting your reference number.
7. Statutory Rights
7a. Cavendish Flowers aim to provide the best floral and gift delivery service possible. If you are unhappy with our service in anyway please contact us via e-mail or telephone and we will investigate the problem as soon as possible.
7b. If after investigation we find the complaint genuine we will offer a suitable replacement or full or part refund. This does not affect your statutory rights as a customer.
8. Privacy
8a. Cavendish Flowers will not share our customers personal, confidential information with any third parties without consent.
8b. For all transactions, we use current Internet security methods and technologies to ensure your details are secure.
8c. For your security, our payment details page is protected using a 128-bit
encrypted secure certificate, along with the added security of PGP encryption software.
8d. Cavendish Flowers does not store any payment details.
9.Customer Service
9a. If you wish to make a complaint you can contact us by e-mail (see contact us page), telephone or post, see below.
9b. Complaints should be sent to us as soon as possible due to the nature of our products but within 7 days of the delivery or intended delivery date.
9c. Complaints will be dealt with as soon as possible. We will acknowledge your complaint within 3 working days and hope to have the complaint dealt with within 5 working days.

10. Disclaimer
10a. Cavendish Flowers shall be released from these terms and conditions in events that are beyond our reasonable control, I.e acts of God, civil commotion, riot, flood, fire and drought which affect the Cavendish Flowers site and its service.
10b We aim to ensure that the website and telephone service is always operating but this cannot always be the case. We therefore accept no liability or responsibility for any interruption to our service.
10c. We exclude all liability for any claims, losses, demands and damages, including without limitation, any costs, loss of profits, loss of contracts or business opportunity, loss of data and any other consequential, incidental, special or punitive damages, even if we have been advised of the possibility of such damages, arising directly or indirectly out of or in any way connected with your use or inability to access the Cavendish Flowers Site and/or the Cavendish Flowers Service, whether arising in contract, tort (including negligence), under statute or otherwise provided that nothing contained in these Terms and Conditions affects or will affect your or the recipient's statutory rights in relation to the quality, fitness or description of the Cavendish Flowers Products supplied
11. General
11a. Cavendish Flowers reserves the right to amend these terms and conditions at anytime. Amendments will be shown within 24 hours and these will overrule the previous terms and conditions.
11b. We reserve the right to restrict, suspend or terminate access to Cavendish Flowers website at anytime.
11c. We shall ensure that we comply with the requirement of all current data protection legislation including, without limitation, the Data Protection Act 1998 (as replaced, modified or re-enacted from time to time). We shall only use personal data received from you for the purpose of fulfilling our obligations under these Terms and Conditions and as stated in our Privacy Policy.
11d. Your purchase will be deemed to have occurred in the UK. These Terms and Conditions shall be governed by and construed in accordance with English Law and the parties agree to submit to the exclusive jurisdiction of the English courts.
12. Free Chocolates
12a. The free chocolates offer is valid only whilst stocks last and when purchasing one or more bouquets for Next day delivery (Tues-Sat).
